Of Swain’s Creek Pines Lot
Owners Association
Meeting
called to order at 10:00 AM. Alan Zellhoefer, Andy Osterhout, Gary
Decker, Irene Briggs, Cheryl Case, Gayle Cromer, and John Ewing, present. Bill Rodreick, Manager, was also present. Robert Storie and
Frank Pearce were not present. Frank’s proxy was given to Alan.
Secretary’s report: Cheryl Case stated page 3
should be amended. Motion by Irene Briggs to accept the July
15, 2006 minutes as amended. Seconded by Gary Decker.
Motion carried.
Treasurer’s report: Irene Briggs stated the current total is $120,813.27, there is
$42,317.91
positive cash flow. Motion by Cheryl Case to accept the treasurer’s report. Seconded
by John
Manager’s report: Bill Rodreick stated no water tests are due
until October 1. Three weeks ago
the well went down for two days
due to a lightening strike. A capacitor was replaced. Dave
repaired the water pump on the 93
GMC truck. A leaking exhaust gasket was repaired on the
2000
Chevy. Water
delivery to date is 897 loads compared to 749 loads last year. The trenching
contractors feel they are on time. The
roof on the water tank on the hill will be poured next week;
the tank will be sanitized and
filled. All barrels in Blackman Hills have been set. All barrels in
area by Alan Zellhoefer
have been set, except the area at Ponderosa. Some fire hydrants have not
been set yet. 2/10 of mile of
main line is not done. The gates on the pond are closed, the pond is
filling back up. If necessary, more
water may be released. All trenching on north end is done.
Irene Briggs stated Mike
Noel asked to publicly thank Bill Rodreick and Dave
Alcorn for their
cooperation.
Committee reports:
Budget: Irene Briggs – there is $42,317.91 positive cash flow, with $11,147.40
positive cash
budgeted at the end of the year. We
are on target and have not exceeded in any area except for
minor repairs on vehicle.
Liens:
Irene Briggs stated one lien is being satisfied due to a sale. There are 4
liens for 2006.
Two other liens have been
satisfied. There are 11 liens, with a total value of $4, 736.50.
Reserve to Preserve: Irene Briggs stated we are on target to fund the
account.
Labor Day: Teresa Zellhoefer stated Bob Runkle took care of getting wood for the fire pit, and
some shopping is done. Bob Runkle stated we have a verbal approval for the fire from
Kenny,
the fire chief. Irene Briggs
stated the quilts are finished; anyone interested in pre-selling raffle
tickets should contact Irene. Gayle
Cromer stated the meat will be prepared Saturday at 3:00
PM. Irene asked for
contributions for the raffle. Gayle stated Mary Dinardi
will contribute
another painting. Irene stated the
schedule that was sent out in the last mailing has been changed

stated the

the obstacle course area. Irene thanked Dee Ewing, Houston, Morgan
&
Water and Pond: John Ewing stated there is a little water,
and very few fish. John suggested
putting an item on the agenda for
the recent tax increases in valuation as his increased 300% tax
increase valuation. Irene Briggs
stated there is a public hearing at Kane county; she can email the
date to anyone interested. Irene
further stated the county now uses a 100% value, instead of the
prior 80% value; the tax rate has
not increase, but valuation increased. Cheryl Case stated she
talked with Kane county, who said
values had not been reset for five years; properties are now
valued at sale prices. People can
challenge their values by getting an appraisal, or comps within
6 months for similar
properties and submit information to Kane for review. Bill Rodreick
stated
the pond is up a foot or two,
and will continue to fill. Motion by Gary Decker to pursue planting
fish. There was discussion
regarding ordering fish. Bob Runkle stated the water
is to warm to
plant fish. Alan Zellhoefer suggested a casting contest if there is no
fishing. Irene stated she
received an invoice for $110.00 from
the Rural Water Association Of Utah; we are members.
Following discussion, Alan
stated there is no need to renew the membership.

Insurance: Irene Briggs stated there are no new increases. The airport insurance
is at the same
figure as last year. Alan Zellhoefer thanked John Ewing for his work with the airport
insurance.
Environmental & Fence: Dee Ewing stated she worked with a group for a
couple of sessions.
Andy Osterhout
stated there has been no other work since the last time out with Paul and Dee
and the group. There are cows
at south end, none have come in the development.
Roads, Parking & Facilities: Irene Briggs stated the Western Kane County
Special Services
District (WKCSSD) does our
garbage pickup; dumpsters were allowed within the subdivision by
the horse corral while WKCSSD work
on transfer station plans. The dumpsters may be here
longer than one year due to delays
by the
and may ask to acquire property
in our subdivision. The

Thursday-Friday from 1:00 PM– 6:00 PM, and on Saturday from 10:00 AM to
6:00 PM. Irene stated the
Deed for Grant of Easement from South Central Telephone has been
recorded. The Deed was given to
Cheryl Case. Gary Decker complimented Irene for all the
work she has done. Pursuant to
request of Bob Runkle, Irene Briggs left the meeting.
Bob stated
people have suggested something
special be done for Irene, and recommended the pavilion be
dedicated in her name. Following
discussion, John Ewing moved to provide a plaque
thanking Irene for her extra effort,
plaque not to exceed $100.00. Seconded by Gary Decker.
Motion carried. Teresa Zellhofer volunteered to obtain plaque to be presented at
Labor Day.
Irene Briggs returned to the
meeting.
Fire & EMS: Jayne Alcorn stated she
has been working with Kanab to get dates for

There was discussion regarding hosting a bar-b-que for workers next year. The County will contract out the
road job. The County, through Western Rock, is providing rock for this job.
Alan stated there is a potluck dinner tonight at the
pavilion, all are invited. Those who want to use the pavilion for other reasons
should contact Bill Rodreick as he has the schedule.
Newsletter: Cheryl Case stated the next newsletter will go out in October. Alan Zellhoefer
stated information is on the
website; some people were unaware the connection from barrel to
their cabin is at their own cost.
The $4000 fee does not include hook-up to individual water
systems. Irene Briggs commended
Karen Kegley for her website and newsletter work.
Elections: Gayle Cromer stated we are covered; Una Runkle has vote counters and all materials.
People can mail in their
vote, or vote in person.
Personnel Supervisor: Irene Briggs stated Bill and Dave take care of
everything.
CC&R’s: Jayne Alcorn & Paul
Hicks – no report.
Nominations: Cheryl Case stated we do not need this committee until May. Gayle
Cromer
thanked Cheryl for working on this
committee. Cheryl Case thanked Bob Runkle for his
assistance.
Architectural: Gary Decker stated five new applications have been received. Bill Rodreick
stated some of those jobs have
started. More applications should have been submitted. Alan
Zellhoefer stated at the last meeting
he mentioned a pink house; the roof is blending down and
looks nice. Alan retracted his
prior comment and asked for apologies. Bill Rodreick
stated he
talked to neighbors who are not
offended. The color is not what it was supposed to be, but it is
aging and getting better. Bill Rodreick provided four citations to Alan, who gave them to
Gary and Alan will follow up
on the citations and take further action if needed.
Water Conservancy: Andy Osterhout stated the water system is
being installed. Gary Decker
stated the website has updates
posted. Gayle Cromer encouraged people to attend the meetings
and stated people should shut
the water off when they leave for the weekend or longer; if there is
a leak, the lot owner is
responsible for the water. Andy stated two crews are installing meter
barrels; some of the employees will
hook up if you are there, one charges $40. Andy also hooks
up to the water system. Irene
Briggs stated Jeff Hoyt will talk at the Labor Day meeting, and at
another meeting. There was
discussion regarding construction.
Security: Irene Briggs –
Bob Runkle
stated there have been some burglaries in last 6 months. Someone turned
everything
over including mattresses, took
tools, a chain saw, a mountain bike, and went to Barbara
Christensen’s and took
numerous things. The burglaries started as construction started. A
suspect is a known 311 Boyz member with the last name of Henry. Watch for a red or
black ford ranger with dents in
front. Gayle Cromer stated there were two break-ins in
Strawberry last night; Meadowview
has had burglaries too. If there is anything unusual, write
down the license place
number and time, call Bob at 249-8687 or his cabin, or call the barn, 911,
or the Sheriff. Irene Briggs
stated we have 24/7 coverage from the Sheriff. Gayle stated it is
bow hunting season now; shots
have been fired behind her cabin. People should call 911 and
report gun shots. Alan Zellhoefer recommended people protect themselves first,
take pictures,
write information down, and do
not approach or challenge possible criminals.
Old business: - none.
New business: Irene Briggs stated there is a state ordered public open house
regarding a waste
water planning study, sponsored
by the Kane County Water Conservancy District, on Monday,
September
4 from 9am – noon at the Cedar Mountain Fire Protection station. Gary Decker
encouraged people to attend the open
house.
Open meeting: Following discussion, Jeff Hoyt stated sanitized water will have high
concentrated chlorine when the system is
tested; water will be put in water truck and on
the roads. There was discussion
regarding Swains Creek related websites, which will be
included in the next newsletter. There
was discussion regarding firepits; diagrams for
approved
pits are posted at the barn. There
was discussion regarding extremely dusty roads on Spruce and
Heavenly. Next year roads will be
improved. Jeff Hoyt stated the Association could pay for mag
chloride to be put on the roads at a
cost of $2,000 per mile, or $40 per lot. There was discussion
regarding ATV accidents, speed
limits, and a parent’s responsibility to inform their children.
There was discussion
regarding trenching to hook up to the water system. Jeff at the hardware
store is charging $25 per foot for
dirt, and double for rocks. Stan Bergstrom charges $10 per
foot. Dave Braucher
stated Rivers charged $7 per foot for drilling and blasting; digging was not
included in that price.
Meeting schedule: September 3rd
(annual meeting), October 7th, and January 20th, 2007.
